What Is the Timeline for Receiving My Workers Compensation?

If you are injured while on the job, never delay in reporting it to your employer. There are deadlines that must be met by both sides. As soon as the injury occurs, report it to your employer so they can immediately notify their insurance company. The next step is to seek medical treatment as soon as possible.

How Long Do You Have to Report Your Injury?

Once you have notified your employer and went to see a physician, it’s up to your employer to notify their insurance company. In most cases, it can take your employer up to three days to notify their insurance carrier. This is especially true if the accident occurs at night or over the weekend. They also have up to ten (10) days to file a “First Report of Injury” with your state’s labor board.

Your Insurance Company’s Decision

You should receive a decision from your employer’s insurance company by the 21st day after the accident. They can agree to the validity of your claim, ask for an extension, or deny your claim altogether. If the insurance company agrees to pay your claim, you should receive your first settlement by the 28th day.
