How Long Do You Have to Report Your Injury?
Once you have notified your employer and went to see a physician, it’s up to your employer to notify their insurance company. In most cases, it can take your employer up to three days to notify their insurance carrier. This is especially true if the accident occurs at night or over the weekend. They also have up to ten (10) days to file a “First Report of Injury” with your state’s labor board.
Your Insurance Company’s Decision
You should receive a decision from your employer’s insurance company by the 21st day after the accident. They can agree to the validity of your claim, ask for an extension, or deny your claim altogether. If the insurance company agrees to pay your claim, you should receive your first settlement by the 28th day.
What You Need to Do
While you are waiting for the insurance company’s decision, you should look into hiring a personal injury attorney to protect your rights and ensure that your medical expenses are paid for. If the insurance company asks for an extension or denies your claim, an attorney can negotiate with them so that everyone reaches a mutual agreement.
